Terms of Use

Last updated: October 17, 2026

This translation is provided for convenience. If it differs from the Portuguese version, the Portuguese version prevails.

These Terms of Use govern the use of FinlyUp, the financial and operational analysis software offered by Pedro Luiz Chagas, CNPJ 24.811.306/0001-96, whose address is Rua Equador, 121 – Nações, Divinópolis/MG, CEP 35500-564 (“FinlyUp”, “we”). By creating an account or using FinlyUp, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

1. Who may use FinlyUp

FinlyUp is meant for businesses and the professionals who serve them, such as accountants and consultants. To create an account, you must be at least 18 years old and legally able to enter into contracts.

If you use FinlyUp on behalf of a company, you represent that you have the authority to accept these Terms for it; in that case, “you” also refers to that company.

2. What FinlyUp is

FinlyUp organizes the reports you import (Excel, CSV, TXT or PDF) and the data you enter, and from them calculates the income statement, cash flow, cash forecast, payables and receivables, sales, purchases, inventory, pricing and indicators, with insights and an artificial intelligence assistant.

FinlyUp is a management tool. It does not issue invoices, keep accounting books or calculate taxes, does not move money and does not replace your accountant, auditor or financial advisor. Results depend on the quality and completeness of the data you provide.

3. Account, workspace and team

Your data lives in a workspace, which can hold several companies. Whoever creates the workspace is its owner. The owner and the admins invite people by e-mail and choose each person’s role (owner, admin, analyst or viewer). Every member of a workspace can access its companies, within the limits of their role.

  • Keep your account details accurate and your password secret. We recommend turning on two-step verification.
  • You are responsible for what is done with your account and for whom you invite to your workspace.
  • If you suspect unauthorized use, tell us right away at suporte@finlyup.com.br.

4. Your data

The data you import or enter (“Customer Data”) remains yours. You authorize us to store, process and display it only to provide the service, including through the providers described in the Privacy Policy.

When Customer Data includes personal data of third parties — your customers, suppliers or staff who are individuals — you are the controller of that data and FinlyUp acts as a processor, under Brazil’s General Data Protection Law (Law No. 13,709/2018). You must have a legal basis to process that data and to send it to FinlyUp.

We do not sell your data, use it for advertising or use it to train artificial intelligence models. The demo company’s data is fictitious.

5. Artificial intelligence

Some features use third-party artificial intelligence models: the assistant, the executive summary, the explanations, report recognition during import and PDF reading.

  • The AI does not do the calculations: the numbers come from FinlyUp’s deterministic calculations. Even so, AI-generated text may contain errors or inaccuracies; check the relevant information before deciding.
  • AI answers are for information only and are not financial, accounting, tax, legal or investment advice.
  • Any data change suggested by the AI is only applied after you confirm it.
  • The owner and the admins can turn off AI for the workspace at any time and set a monthly usage limit; the rest of FinlyUp keeps working.

6. Prices and free trial

FinlyUp is charged per company analyzed, as a monthly subscription: each company (each CNPJ, in Brazil) has its own subscription and its own renewal date. The current price is the one shown on the website and confirmed before you subscribe. Workspaces in Brazil pay in Brazilian reais; all others pay in US dollars.

  • Free trial: the first company in each workspace gets 7 free days. The card is added when the trial starts and the first monthly payment is charged when it ends, unless you cancel before. The trial can be used only once per person and once per CNPJ.
  • Additional companies: they are charged when added, with no free trial and no proration, and renew on the same day in the following months.
  • Demo company: it is free.
  • Payment: monthly fees are charged in advance to the card on file. Payments are processed by Stripe; FinlyUp does not store your card details.

We may change prices with at least 30 days’ notice by e-mail. The new price applies from the first renewal after that period, and you may cancel before it.

We issue invoices for the amounts paid as required by applicable law.

7. Non-payment

If a monthly payment fails, we will retry it over the following days. Meanwhile, access to the company continues, with a notice in the app to update the card. If the new attempts also fail, the subscription ends and the rules in “Cancellation and end of the subscription” apply. An additional company is unlocked only after its first monthly payment.

8. Cancellation and end of the subscription

The workspace owner can cancel any company’s subscription at any time, in Settings → Plan and billing. Cancellation takes effect at the end of the period already paid; until then, access continues and the cancellation can be undone.

There are no fees and no minimum term. Amounts for periods that have already started are not refunded, except where the law requires it — for example, the consumer’s right of withdrawal under Article 49 of Brazil’s Consumer Protection Code, when applicable.

After the subscription ends:

  • for 30 days, the company is available read-only;
  • after that, access to it is blocked;
  • 90 days after the end, the company’s data is permanently deleted — we notify you by e-mail 7 days before.

Deleting a company cancels its subscription immediately and erases its data, which cannot be recovered. While the data exists, you can request a copy of it at suporte@finlyup.com.br.

9. Acceptable use

You agree not to:

  • use FinlyUp for unlawful purposes or to process data without a legal basis;
  • try to access other customers’ data, circumvent limits or security mechanisms, or test for vulnerabilities without our prior written authorization;
  • upload malicious code, overload the service or extract data automatically outside the features provided;
  • copy, resell or sublicense FinlyUp, or reverse engineer it, except where the law allows;
  • share your account: to give other people access, invite them to the workspace.

If you breach these rules, we may suspend access as described in “Suspension and termination”.

10. Availability and changes to the service

We work to keep FinlyUp available and secure, but we do not guarantee uninterrupted or error-free operation. Maintenance and failures of infrastructure providers may occur.

FinlyUp evolves: we may add, change or remove features. Changes that materially reduce what you subscribed to will be announced reasonably in advance.

11. Intellectual property

FinlyUp’s software, brand, design and content belong to Pedro Luiz Chagas or to our licensors. During the subscription, you receive a non-exclusive, non-transferable license to use FinlyUp under these Terms.

Suggestions you send us may be used to improve the product, with no obligation to compensate you.

12. Liability

You are responsible for the accuracy and lawful origin of the data you send and for the decisions you make based on FinlyUp’s analyses.

To the extent permitted by law, we are not liable for lost profits, lost opportunities or indirect damages, and our total liability is limited to the amount you paid us in the 12 months before the event. These limits do not apply where the law forbids them, such as in cases of willful misconduct or gross negligence and in consumer relationships.

13. Suspension and termination

We may suspend or terminate access in case of a breach of these Terms, fraud, a risk to the security of the service or of other customers, or an order from a competent authority. Whenever possible, we will warn you first and give you time to fix the issue.

You may stop using FinlyUp at any time, with no fee: in the app, by canceling the subscriptions or deleting the companies, as described in “Cancellation and end of the subscription”. Deleting the account and the workspace is done on request, by e-mail to privacidade@finlyup.com.br.

14. Changes to these Terms

We may update these Terms. Material changes will be announced by e-mail or in FinlyUp at least 30 days in advance, and the date of the current version is shown at the top of this page. If you do not agree, you may cancel before the change takes effect.

15. Governing law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of Divinópolis/MG are chosen to settle any disputes, without prejudice to a consumer’s right to sue in the courts of their own domicile.
